Factual findings from the district court reveal that Medina's backpack was sitting on the hood of the squad car—immediately in front of Medina and within his reach—that it was heavy, and that Medina had just lied to officers regarding its contents. His statement that the backpack contained only clothes was suspect in light of its weight. The patdown revealed a hard object making the statement even more suspect. In light of these facts, it was reasonable for Officer Burke to believe that the backpack possibly contained a weapon. As Medina's ensuing flight demonstrated, he was not handcuffed, confined, or otherwise under the control of the officers; he was physically able to break loose from the officers. Hence, it was also reasonable for Officer Burke to believe that Medina could gain control of a weapon and use it against the officers. Since the physical scope of a Terry protective search extends to those areas from which the suspect may gain immediate control of a weapon, Long,463U.S. at1049, and Medina could reach his backpack, it follows that it was reasonable for Officer Burke to pat down the backpack as part of his protective search. Once he felt the weapon, he had reasonable suspicion to open the backpack and search its contents. Under the facts of this case, the backpack was within the permissible scope of the officers' protective search 📌 United States v. Medina, 130 F. App'x 862, 864 (9th Cir. 2005) And the one you mentioned: It should be noted that the distinction between a pat down of Hernandez–Mendez's clothing and a pat down of her purse is not meaningful in this particular context. At the time she was detained, Hernandez–Mendez was wearing a tank top shirt and shorts and was carrying a purse. Given her clothing, there were few places that she could conceal a weapon other than in her purse, making it objectively reasonable to frisk her purse in addition to her person. See, e.g., United States v. Williams, 962 F.2d 1218, 1223–24 (6th Cir.1992) (finding frisk of purse “a reasonable self-protective measure”); 4 Wayne R. LaFave, Search and Seizure § 9.6(e) (4th ed. 2004) (noting that many courts have upheld the reasonableness of police protective searches of items carried by suspect at the time of a Terry stop). United States v. Hernandez-Mendez, 626 F.3d 203, 213 (4th Cir. 2010) As for coats, yes if it's reasonable. I call this "peeling the onion" cases: Police officer did not exceed scope of permissible Terry protective frisk of defendant's side for a weapon or bomb during course of drug surveillance at bus station, where officer did not reach under defendant's clothing and officer briefly touched an area on top of defendant's clothes that was visible to him after defendant lifted blanket that she wore around her shoulders. 📌 United States v. “[T]he authority to search incident to arrest derives from the need to disarm and prevent any evidence from being concealed or destroyed.” State v. Greenwald, 109 Nev. 808, 810, 858 P.2d 36, 37 (1993). Here, the search occurred after officers arrested Nye, secured her inside a patrol car, put her backpack in the trunk, and took her to jail. Thus, at the time of the search, Nye did not pose a threat to officer safety. Nor was there an immediate need to preserve evidence because she had been and remained separated from her backpack. Accordingly, the district court did not err when it concluded that the search of Nye's backpack was not a lawful search incident to arrest. State v. Nye, 136 Nev. 421, 423, 468 P.3d 369, 371 (2020) Have a search and seizure question in mind?
